Terms of Service

Welcome to Blaqapp. These Terms of Service (“Terms”) are a legally binding agreement between you and BlaqApp, a company registered in Nigeria (“Blaqapp,” “we,” “us,” or “our”), governing your access to and use of the Blaqapp platform.

By accessing, registering for, or using Blaqapp, including through its website, mobile applications, APIs, software, or other services, you agree to be bound by these Terms and the Blaqapp Privacy Policy. If you do not agree to these Terms, you must not access or use Blaqapp.

1. About Blaqapp

Blaqapp is a global video and livestreaming platform that enables users to discover, watch, upload, publish, livestream, interact with other users, and, where eligible, monetize their content. The Services may include video streaming, livestreaming, profiles, channels, comments, likes, follows, shares, messaging, virtual gifts, coins, subscriptions, creator programs, advertising, recommendations, search, personalization, content moderation, and other features introduced from time to time.

Blaqapp may modify, suspend, replace, or discontinue any feature or part of the Services at any time.

2. Acceptance of These Terms

By accessing or using Blaqapp, you agree to these Terms and the Blaqapp Privacy Policy. You confirm that you are legally capable of entering into a binding agreement in your jurisdiction and that your use of Blaqapp complies with applicable law. If you use Blaqapp on behalf of a company or organization, you represent that you have authority to bind that entity.

3. Eligibility and Age Requirements

You must be at least 13 years old to create an account or use Blaqapp. Blaqapp is not directed to children under 13, and we do not knowingly permit them to use the Services. If we learn that an account belongs to someone under 13, we terminate it and delete the associated data.

Some features are restricted to users aged 18 and over. You must be at least 18 years old to livestream, appear as a co-host, purchase coins, send or receive gifts, earn creator rewards, or request a withdrawal. Users aged 13 to 17 may watch livestreams, chat, follow creators, and otherwise use the non-monetized parts of the Services.

We ask for your date of birth when you create your account, and we use it to apply these age requirements. You must provide your real date of birth. Because it determines access to age-restricted features, your date of birth cannot be changed in the app once set — contact [email protected] if you need to correct it. Providing a false date of birth to gain access to age-restricted features is a breach of these Terms and may result in termination.

Blaqapp is intended for users legally permitted to use online video and social media services in their jurisdiction. You must not use Blaqapp if you are legally prohibited from doing so, have been permanently banned unless authorized to return, are impersonating another person, are using the Services for unlawful purposes, or cannot legally agree to these Terms. Where you are under the age of majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Specific features may have additional age, identity-verification, geographic, or eligibility requirements.

4. Accounts and Security

You must provide accurate, current, and complete information when creating an account and keep it updated. You are responsible for your login credentials, account security, activity conducted through your account, and promptly reporting suspected unauthorized access.

You must not create accounts using false information, impersonate another person or organization, create accounts for fraud or abuse, create accounts in bulk to evade restrictions, sell or rent accounts without authorization, or use another user's account without authorization. Blaqapp may require identity verification for livestreaming, monetization, withdrawals, paid features, or other high-risk activities.

5. License to Use Blaqapp

Subject to these Terms, Blaqapp grants you a limited, personal, worldwide, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services. This license does not give you ownership of Blaqapp's software, application, website, trademarks, logos, systems, algorithms, databases, interfaces, or other intellectual property.

6. Prohibited Conduct

You must not use Blaqapp to violate law, facilitate criminal activity, threaten or harm others, promote terrorism or violent extremism, encourage suicide or self-harm, facilitate trafficking or exploitation, or coordinate unlawful conduct.

  • You must not promote hatred, violence, discrimination, credible threats, targeted harassment, dehumanization, or coordinated abuse.
  • You must not distribute child sexual exploitation material, non-consensual intimate imagery, sexual exploitation, sexual extortion, sexual trafficking, or other unlawful sexual material. Blaqapp has zero tolerance for child sexual abuse and exploitation: such content and conduct result in immediate removal, permanent account termination, and reporting to the National Center for Missing & Exploited Children and to law enforcement.   • You must not sexualize a minor, groom a minor, solicit sexual contact with a minor, or request or share a minor's intimate imagery or contact details for the purpose of exploitation.
  • You must not conduct scams, phishing, fraudulent investment schemes, deceptive giveaways, impersonation, or other fraudulent conduct.
  • You must not use bots, click farms, fake accounts, or other systems to artificially inflate views, likes, followers, comments, or other engagement.
  • You must not introduce malware, bypass security, gain unauthorized access, probe systems without authorization, interfere with infrastructure, or conduct denial-of-service attacks.
  • You must not publish another person's private or sensitive information without lawful authorization.

7. User Content

User Content includes videos, livestreams, audio, music, photographs, images, text, comments, captions, usernames, profile content, artwork, graphics, messages, reactions, and other material submitted or transmitted through Blaqapp.

You retain ownership of User Content that you own. By uploading, transmitting, publishing, or livestreaming User Content, you grant Blaqapp a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, adapt, modify, format, encode, transcode, display, publicly perform, distribute, communicate, promote, advertise, and otherwise use that User Content as reasonably necessary to operate, provide, improve, secure, moderate, promote, and develop Blaqapp and its Services.

This license may continue as reasonably necessary to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, maintain backups, prevent fraud and abuse, and protect legitimate business interests. Public content may be copied, downloaded, recorded, redistributed, or otherwise used by other people.

8. Your Content Warranties

By submitting User Content, you represent and warrant that you own the content or have all necessary rights and permissions; you have authority to grant the license described in these Terms; the content does not unlawfully infringe intellectual property, privacy, or publicity rights; necessary permissions and music rights have been obtained; the content complies with these Terms and applicable law; and the content does not contain malicious code.

9. Livestreaming

You must be at least 18 years old to livestream or to appear as a co-host on another user's livestream. Users under 18 may watch and participate in chat.

Blaqapp may permit eligible users to livestream. Livestreamers are responsible for their own conduct, guests and participants, broadcast content, music and third-party material, commercial disclosures, and compliance with law and Blaqapp policies.

Blaqapp may review or monitor livestreams, use automated detection systems, limit distribution, interrupt or terminate livestreams, restrict livestreaming privileges, remove recordings, or suspend or terminate accounts. Blaqapp does not guarantee uninterrupted availability or indefinite preservation of livestreams.

10. Monetization

Blaqapp may offer eligible users monetization through advertising revenue sharing, subscriptions, memberships, virtual gifts, creator rewards, sponsorships, paid content, tips, affiliate programs, or other programs.

You must be at least 18 years old to participate in any monetization program, including earning or withdrawing creator rewards.

Eligibility is not automatic and may depend on age, identity verification, location, account standing, performance, content compliance, tax information, payment information, anti-fraud checks, and other requirements.

Blaqapp may change, suspend, or terminate monetization programs. You are responsible for accurate payment information and all applicable tax obligations. Blaqapp may withhold, delay, reverse, deduct, or refuse payments due to fraud, chargebacks, suspicious activity, policy violations, unlawful activity, payment-provider restrictions, verification issues, or legal requirements. Monetization balances are not guaranteed income, bank deposits, or securities unless expressly stated otherwise.

11. Virtual Items, Coins, Gifts, and Digital Benefits

You must be at least 18 years old to purchase coins or to send or receive gifts.

Blaqapp may offer virtual currencies, coins, points, gifts, badges, credits, or other digital items. Unless otherwise required by law, these items are licensed, not sold; have no cash value outside the Blaqapp ecosystem; cannot be exchanged for cash except through an authorized program; cannot be transferred outside Blaqapp; and may be modified or discontinued. Additional rules may apply to purchases and use.

Coins purchased on Android are sold through Google Play and are subject to Google Play's terms and refund policy. If your account is deleted, any remaining coin balance is forfeited and is not refundable.

12. Payments and Refunds

Paid features may be processed by third-party payment providers. Unless applicable law requires otherwise, purchases are generally final and non-refundable except where Blaqapp expressly provides a refund, a transaction was unauthorized, a payment was processed in error, or a refund is legally required. App-store purchases may be subject to applicable app-store rules.

13. Advertising and Commercial Content

Blaqapp may display advertising and sponsored content. Advertisers, creators, and businesses are responsible for complying with applicable laws. Paid promotional content must include legally required disclosures. You must not promote illegal products or services, make deceptive claims, impersonate businesses, or promote prohibited goods or services.

14. Intellectual Property

Blaqapp and its licensors own or control the Services and related intellectual property, including software, source code, interfaces, designs, trademarks, logos, names, graphics, text, databases, algorithms, platform architecture, audiovisual elements, and other proprietary materials. You may not copy, reproduce, modify, distribute, sell, license, lease, reverse engineer, or exploit Blaqapp intellectual property without authorization.

15. Copyright and IP Complaints

If you believe content on Blaqapp infringes your copyright or other intellectual property rights, contact [email protected] with sufficient information identifying the allegedly infringing material, the protected work or right, your relationship to the rightsholder, the location of the material, and contact information for follow-up. Blaqapp may remove or restrict allegedly infringing content and may take action against repeat infringers.

16. Content Moderation

Blaqapp may use automated systems, human reviewers, user reports, trusted safety partners, technology providers, and other processes to detect, review, restrict, remove, or moderate content and activity.

Actions may include warnings, content removal, reduced distribution, age restrictions, feature disabling, livestream interruption, demonetization, account suspension, account termination, or referral to law enforcement where appropriate. Blaqapp does not guarantee that all prohibited content will be detected or removed.

17. Reporting and Appeals

Reports must be truthful and made in good faith. Abuse of reporting systems may violate these Terms. Where available, users may appeal certain moderation decisions through Blaqapp's designated process. Appeal procedures may vary based on the violation, user location, applicable law, seriousness, and feature involved.

18. Third-Party Services

Blaqapp may integrate with payment providers, app stores, analytics providers, advertising providers, identity-verification providers, cloud infrastructure providers, and other third parties. Third-party services may have separate terms and privacy policies. Blaqapp is not responsible for third-party services it does not control.

19. Availability

Blaqapp is provided on an “as available” basis. We do not guarantee uninterrupted availability, error-free operation, permanent content preservation, uninterrupted livestreams, accurate recommendations, or that the Services will satisfy every user's requirements. Maintenance, updates, upgrades, and security measures may temporarily affect availability.

20. Disclaimers

To the maximum extent permitted by law, Blaqapp is provided without warranties except those that cannot legally be excluded. Blaqapp does not guarantee the accuracy, reliability, completeness, legality, safety, or availability of User Content. You access User Content at your own risk.

21. Limitation of Liability

To the maximum extent permitted by law, Blaqapp and its officers, directors, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services, including loss of profits, revenue, business, goodwill, data, opportunities, or anticipated savings. Nothing excludes liability that cannot legally be excluded.

22. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Blaqapp and its affiliates, officers, directors, employees, contractors, and agents from claims, losses, liabilities, damages, costs, and expenses arising from your breach of these Terms, User Content, violation of another person's rights, unlawful conduct, use of monetization features, or violation of applicable law.

23. Suspension and Termination

You may stop using Blaqapp at any time. Blaqapp may suspend, restrict, or terminate accounts or access for violations of these Terms or law, security risks, fraud, threats to users or the platform, legal requirements, or other protective reasons. Where appropriate, Blaqapp may provide notice and an opportunity to appeal. Provisions concerning intellectual property, User Content licenses, payments, liability, indemnification, dispute resolution, and other provisions that should survive will survive termination.

You may delete your account at any time from Profile then Settings then Delete Account in the app, or by requesting deletion at blaqapps.com/delete-account. Deletion is permanent: your profile and content are removed, and any remaining coin balance is forfeited. We retain a limited set of transaction and payout records where the law requires it, unlinked from your profile. Withdraw any earnings you are eligible for before deleting.

24. Changes to These Terms

We may update these Terms. For material changes, we may provide notice through the Services, email, account notifications, or other reasonable means. Continued use after the effective date may constitute acceptance of revised Terms.

25. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, except to the extent mandatory laws of your jurisdiction apply. The parties should first attempt in good faith to resolve disputes through written notice and reasonable discussions. Nothing prevents users from exercising mandatory statutory rights that cannot lawfully be waived. The courts of Nigeria shall have jurisdiction subject to mandatory jurisdictional protections.

26. General Terms

If any provision is invalid or unenforceable, the remaining provisions remain effective. Failure to enforce a provision does not waive the right to enforce it later. You may not transfer your rights without written consent. Blaqapp may assign its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or similar transaction.
